Judge sets deadline for accused in Gol case to present defense

Boeing and jet collided in midair in 2006, and 154 people died.
Magistrate determines interruption of pilots' questioning in USA.

The federal judge in Sinop (MT), Murilo Mendes, this Tuesday, September 30, determined that the defenses of pilots Jan Paul Paladino and Joseph Lepore and of four air traffic controllers be cited to present, in ten days, a written defense. The six are defendants in the trial on the Gol 1907 accident, which killed 154 people in September of 2006.

A change in the Code of Criminal Procedure, which took place in August, gives the defendants the right to be heard last, after the prosecution's witnesses, and those that may be indicated by the defense. Before the alteration, the interrogation of the witnesses for the prosecution and the defense were always done after the defendant was heard.

The judge had solicited the realization of the questioning of the North American pilots in the United States. Mendes determined, this Tuesday, that the precatory letters be recalled and the suspension until further order of the questioning of the foreign defendants.

The four Brazilian flight controllers had already been heard by the Court before the change in the criminal code. The magistrate, however, "for a question of equal treatment in the process", conceded them the right to present a written defense in the same time frame. "Otherwise, we would have the trial going on with different rules for the defendants".

Accident

No dia 29 de setembro de 2006, um Boeing da Gol, que fazia o vôo 1907, de Manaus para Brasília, se chocou em pleno ar com um jato Legacy que seguia de São Paulo rumo aos Estados Unidos.

O Boeing caiu em uma região de mata fechada no Norte de Mato Grosso. O acidente deixou 154 mortos - incluindo passageiros e tripulantes da aeronave. O Legacy conseguiu pousar em uma base aérea no Sul do Pará. Os sete ocupantes do jato sobreviveram.

Foi o segundo maior desastre aéreo do país em número de vítimas. Em julho do ano passado, mais um acidente chocou o Brasil. Durante pouso no aeroporto de Congonhas, em São Paulo, um avião da TAM não conseguiu frear e bateu no prédio da TAM Express, causando a morte de 199 pessoas.
